John and Dave have been intimately involved in the legal aspects of all phases of the energy project life cycle, from conceptual stage through commercial operations, sale and even bankruptcy. Along the way, we have represented developers, owners, operators, contractors, manufacturers, and other project participants. Our time as in-house counsel at EPC companies gives us a much more intimate understanding of the legal and commercial aspects of the EPC business than most law firm lawyers who typically represent only one category of project participants (e.g., only owners or only contractors). We are familiar with construction joint venture and consortium agreements, subcontracts with vendors and suppliers, and procurement programs. We understand the dynamic relationship between contractors and major equipment suppliers. We have dealt with direct agreements between project lenders and contractors and the practical impact such agreements have on contractors, especially when the chips are down for the project owners. We bring a broad perspective gained from our involvement in a wide variety of EPC projects in the U.S. and abroad.
