David is a former partner in a major Pacific Northwest law firm, Stoel Rives, LLP. A degreed engineer, David also has considerable experience in general construction matters, including contracting, litigation, arbitration and real estate development. David represented Enron subsidiary NEPCO, with a focus on assisting NEPCO with both legal risk management for its current EPC project workload and legal support for development and negotiation of major new EPC projects. In the wake of the Enron bankruptcy, David and John Schwartzenburg worked together with a larger team to implement an asset sale that preserved the jobs of 3,500 NEPCO employees.
David was subsequently engaged by the Enron estate as outside counsel with primary responsibility for NEPCO related matters within the bankruptcy, which required the coordination of a team of Enron personnel, outside counsel (Milbank Tweed Hadley & McCloy, LLP, Weil Gotshal & Manges, LLP and others) and construction experts in the resolution of 27 major claims, with claim reductions totaling over $540 million. This resulted in more than $240 million in redistributions and $38 million in asset recovery.
More recently, David has been focused on support of energy project development for clients with IPP projects throughout the United States.
David has degrees from Iowa State University (B.S. Civil Engineering, 1983) and the University of Oregon School of Law (J.D. 1988).
David is admitted to practice in the state of Washington (1988), Texas (2008), the U.S. Court of Federal Claims and the U.S Bankruptcy Court for the Southern District of New York (pro hac vice).
